Annual Maintenance Subscription

  (Preamble)
  Whereas the First Party is a specialized company in home maintenance services within the State of Kuwait, possessing the necessary expertise and capabilities to perform all required maintenance work for the property located in Area:…… Block:….. Street:……. Plot:……, both parties, with full legal capacity, have agreed to the following terms and conditions:

  Clause One
  The preamble above is considered an integral part of this contract, and all provisions herein refer back to it for interpretation and application.

  Clause Two
  Both parties agree that the First Party will perform maintenance work as per the provisions of this contract at the prices set by the First Party, which the Second Party agrees to pay as specified in this contract.
  The parties agree that any maintenance work required by the Second Party’s property not covered under this contract will be executed only after a report and quotation are provided to the Second Party, and their written approval is obtained.

  Clause Three
  The contract period is one year, starting from — / — / — and ending on — / — / —, and will renew automatically unless either party notifies the other in writing of their desire not to renew the contract at least 30 days before the expiration date.

  Clause Four
  Subscription fees:

  • Super Subscription: 399 KWD (Three Hundred Ninety-Nine Kuwaiti Dinars) for a maximum of 45 visits.
  • Premium Subscription: 99 KWD (Ninety-Nine Kuwaiti Dinars) for 10 visits.
  • Basic Subscription: 55 KWD (Fifty-Five Kuwaiti Dinars) for 5 visits.

  Payment is to be made in full upon signing. The subscription does not include spare parts, demolition work, repairs requiring external workshops, finishing work, or sewer cleaning with machinery.

  Clause Five (Spare Parts)
  This contract does not cover any spare parts. The Second Party shall pay any invoice issued by the First Party for spare parts provided at the lowest possible cost. Failure to pay for spare parts will render the subscription void.

  Terms and Conditions

  1. No other party than the First Party may perform maintenance services during the contract period. In the event of non-compliance with this clause, the contract will be deemed void.
  2. In case the Second Party fails to fulfill financial obligations as specified in Clause Four, the service will be suspended automatically without the need for legal action.
  3. The Second Party is not entitled to deduct any amounts for service interruption due to their actions, nor to claim compensation with additional time without legal action.
  4. The First Party is not responsible for any damage affecting the scope of work due to external factors such as power outages, disasters, riots, strikes, wars, accidents, neglect, vandalism, misuse, or any reasons beyond the company’s control.
  5. If the contract is canceled by the Second Party after signing, no refunds will be provided, and the amounts paid shall be deemed due to the First Party as administrative fees.
  6. Requests should be submitted through the company’s website. Technical support is available 24/7 for emergencies at 22094040 – 1886554, with visits conducted during business hours per the company’s schedule.

• The scope of plumbing work does not include leak repairs that require breaking floors or walls and does not cover the property’s main drainage work.
• The scope of electrical work does not include internal and external wiring that requires breaking floors or walls and does not cover decoration, insulation, or ceramic work.
• The subscription does not cover any work requiring an external workshop.

Additional Benefits for Subscription Clients

• Upon signing the subscription, the client receives a 50% discount on any work not included in the subscription.
• Provision of spare parts at cost upon the Second Party’s request, with the cost to be paid by the client.
• Priority in fulfilling requests.

Notices
The address of both parties stated in the preamble of this contract shall be their official address, where all correspondences and notices will be sent. This address remains valid for both parties unless one party notifies the other of their new address for approval. This notification must be sent either by registered mail or hand-delivered with a signed receipt.

Each party must notify the other of any address change at least seven days before the change date. Any notice, alert, or warning sent to the address of the other party shall be deemed legally effective if the address change is not in compliance with this article.

Jurisdiction and Venue
This contract is subject to the laws and regulations in force in the State of Kuwait. Any dispute arising from this contract, or because of it, or its execution shall be settled by the competent courts in Kuwait.
